FAQs & Tools for ACA Compliance
The EBSA has published a 10 part set of FAQs about ACA Implementation of the group health plan requirements (Part 7) of ERISA. It was prepared jointly by the Departments of HHS, Labor, and Treasury to answer questions that help Plan Sponsors, TPAs, brokers, and others operating a group health plan understand the new law. The Departments anticipate issuing further responses to questions and other guidance under the ACA in the future.
In our last newsletter, we announced the first Self-Compliance Tool for HIPAA and Other Health Care-Related Provisions. It is a detailed checklist addressing HIPAA, GINA, WHCRA, MHPAEA and other health care-related laws.
The second Self-Compliance Tool for ACA Provisions checklist addresses various provisions such as grandfather plan status; adult dependent coverage age requirements; lifetime and annual limits; prohibition on preexisting condition exclusions for individuals under 19; SBC and uniform glossary provisions; coverage of preventive services; internal claims and appeals and external review requirements.
